After the Supreme Court declined to address the constitutionality of birthright citizenship—and instead limited its ruling to the legality of nationwide injunctions based on claims brought by multiple individual plaintiffs—I realized the only path forward was to get a court to certify a class of plaintiffs all making the same challenge (class action status). Thankfully, that’s exactly what has happened! ❤️

This needs to be done by a lawyer acting on behalf of the clients, NOT the judge, whose role is to assess the merits of the actions. This one step alone is why class actions take so long and this judge completely skipped it.

An article this morning, announcing this class action suit, is accurate except… When it says this will prevent Trump‘s E.O. from being enforced in the 28 states (or so) who had not joined the original nationwide injunction….my first thought is, how can his Executive Order be enforced? It’s unconstitutional! It directly contradicts the birthright citizenship provision stated in the 14th amendment!

The Supreme Court did not rule on the constitutionality of his E.O. They simply ruled on the validity or viability of nationwide injunctions… Forgive me if my confusion is naïve.

If an E.O. is unconstitutional, I don’t understand how it could be enforced. Basic.
