While Newson is deserving of criticism, Trump has called in the national guard against Newson’s wishes - a heavily inflammatory choice meant to stoke the fires of the protests. We need to look at the bigger picture here and question why the mayor and governor may be advocating for the protests to calm: Trump is looking for signs of uncontrollable hostility in order to use overreaching force in a key democratic state and establishing military rule. As the situation develops, Newson has filed a lawsuit but the national guard are not under his control and are federal officers which muddies disciplinary action in addition to a lack of officers to carry out his orders.

The federal government is above the state, by filing a lawsuit that is what he needed to do and the correct step so Newsom isn’t doing anything wrong in this situation such as asking people to makesure things stay peaceful so that Trump’s over reach does not then look as though it’s warranted. Don’t blame us on Aaron, there’s nothing to question so why would he be?

And you don't understand the law. All those actions are legally within the power of representatives of the state of California and do not classify for martial law. If Trump were to enact martial law for California elected officials doing their due process, he would immediately get arrested by the military. For reference, I am a former National Guard member, former sheriff, current licensed and practicing paralegal in the state of California, currently waiting to take my board from law school. So, what legal experience do you have in the federal government and or state of California to be saying this without doing proper research? Your information is biased and incorrect. They would not legally have the justifications to call martial law.

You really need to look into the power breakdown between federal and state and see what the actual limitations are.

Everything the regime is doing and has done is undeniably illegal and unconstitutional. But legally, Newsome needs to follow the law and steps of that law. He’s already sued the feds for infringement of state’s rights.

This isn’t on Aaron. His job is to report what’s actually happening- not change the facts or skew them. FOX is already doing that.

Maybe you should use Google to see what's legally allowed or ask a professional because he's not doing anything besides suing, which does nothing for the people that are illegally being kidnapped in horrible positions. He has the legal power to send in state police to raid the federal buildings and arrest federal officers for breaking federal crime, which is what needs to be done. Because by doing inaction, you are enabling the regime to continue to gain power.

To be clear, what Trump is doing with these ICE raids and the military deployment isn’t just “controversial,” it’s outright illegal in multiple ways. I’m talking about both federal constitutional violations and California state law being broken in real time—and yet everyone’s just standing around like it’s a policy debate. It’s not. It’s lawbreaking.

First, the most obvious violation is habeas corpus—not “Corpus Christi” like some people mistakenly say. Habeas corpus is a constitutional protection that says no person can be detained without being brought before a judge. ICE is detaining people without judicial warrants or due process. That’s a direct violation of Article I, Section 9 of the U.S. Constitution, and it’s not something you can ignore just because you slap “federal authority” on it.

Then there’s California state law, specifically the California Values Act (SB 54). It clearly says that state and local law enforcement can’t cooperate with ICE unless there’s a judicial warrant. That includes everything from sharing data to using state resources. If ICE is operating in California and using any state-based infrastructure—or pressuring local cops to help without a warrant—that’s a violation of state law, period.

Trump’s deployment of the National Guard under federal command (especially without an actual insurrection or rebellion) also walks the line of violating the Posse Comitatus Act and misusing the Insurrection Act, because there is no justification to override the governor’s authority in this case. LAPD already said they had things under control. The unrest had died down before federal troops even showed up.

Now, as for what Governor Newsom can do? More than he’s doing, that’s for sure. Here’s what’s legally on the table for him right now:

Sign an executive order that declares all ICE raids in California unlawful if done without judicial oversight. That gives legal teeth to block or disrupt any action that violates state law or the Constitution.

Authorize state law enforcement to arrest or detain any federal agent operating illegally—especially those violating SB 54 or due process rights.

Cut off federal access to California-run systems and databases—no DMV data, no shared access, no infrastructure support. Force ICE to operate without local support.

File an emergency injunction in federal court to halt all ICE operations violating civil rights or lacking judicial warrants. That puts the burden on the courts to step in.

Direct all California law enforcement to stand down from any federal operation that lacks legal justification and report it instead. Deputize state agencies to protect communities, not hand them over.

So yeah, legally speaking, Newsom could take meaningful action immediately. The problem is, he’s choosing optics over confrontation. He’d rather make speeches and file slow-moving lawsuits than stand up to federal abuse with the full weight of the law behind him.

Anyway, let me know if you want sources or if you're talking to someone about this—I’ve got the actual legal code and precedents handy if needed.

it's not ideology or opinion. I am a former National Guardsman and Sheriff in the state of California and have extensive experience with state and federal law, period. When federal law is broken within the jurisdiction of your state and or county, the mayor of that city and or representative of that county and governor can arrest federal officers under Title 10 for breaking federal crimes within your state.The governor should be issuing an executive order to arrest all federal officers who break Habeas corpuson sight.
