This is one of my biggest fears. When the administration ignored the original judge’s order to bring Garcia home, my immediate thoughts were either they don’t want to bring Garcia back in fear that he will share exactly what is happening down there, including the conditions and how people are being treated, or that Garcia may already be unalived. There is no other reason I can think of for them to stall bringing him back. Not to mention it took several days for them to even make the statement about him being alive. My heart breaks for what he and his family are going through.

Michael B's avatar

There is a very good reason to NOT bring Garcia back. The DOJ lawyer in court today is the same lawyer the is handling the case over the Venezuelans and Salvadorans the were sent at the same time as Garcia. They've tried to make the same BS argument in front of Judge Boesberg, who wasn't buying it either. If the administration makes any effort to return Garcia, it can and likely will be used in the other case to return the Venezuelans and others who may be from other countries .

That case, SCOTUS forced a restart. The ACLU had to file (hopefully by class action) a writ of Habeus Corpus in Texas, that group's last point of common detention in the US. So it won't be Boesberg, but the SCOTUS ruling affects them all.

Garcia is one unique case, but the issue of "facilitating return" is common between them. In fact, because he's Salvadoran, it makes the case to return ALL the people sent unlawfully to El Salvador, even those who are Salvadoran by birth.

FWIW, El Salvador is a nation of laws and the people there also have rights, including Habeus Corpus. They cannot be held in prison without charges against them and due process in the courts. I believe a lawsuit was filed Salvadoran lawyers to get these people released since they haven't been charged with crimes in El Salvador.

Unfortunately, there are reports that the government there has great influence over their courts. They're probably being told the truth. The prisonors are Prisoners of America, and the prison space s being leased by the US govt.

My bet is the president of El Salvador will bring Garcia back to the US on his plane Monday, all clean dressed and fed. This way Trump will have taken no action, and it delays the return of the hundreds of prisoners that much longer.

Expand full comment
Michael B's avatar

Well I was wrong about being returned.

The President and administration is directly and publicly defying the orders of the SCOTUS. The only remedy is court criminal contempt charges against Bondi, Blanch and Rubio, and Impeachment of the POTUS.

My strong opinion on the El Salvador situation is that these immigrants were SOLD INTO SLAVERY to another country! 1. No due process to prove legal or illegal immigrant (my opinion is that all immigrants are welcome here...as we are ALL immigrantsor descendantsof, unless Native American, but I digress) 2. No due process to determine criminal (guilty) or not (innocent). 3. Not returned to country of origin. SOLD. FOR. A. PROFIT. To a random ass country with some of the worst prison conditions.

And the worst part? Complete disregard for ANY checks and balances from the Judiciary.

Not sold. Paying. IThe US has paid $6 million, for the use of that foreign prison. The administration realized when they opened and then had to close the concentration camp in Guantanimo, Cuba., that if the US runs it, the courts can reach it.

They decided to use the same scheme the CIA uses. Black Op sites in foreign countries with cooperation of those governments, paying money keep them secret and blind from oversight. The problem is that this was a huge number, and these people have families so the word got out. If ICE and CBP hadn't been under pressure to round up large numbers to satisfy political quotas this might have gone on longer.

For all we know, CIA interrogators are there in El Salvador, torturing people for "names" to send more on this one way road to a 21st century concentration camp.

Our government messed this up and our government should be the ones to fix it. If DT is so tough as he claims and such a good negotiator, he should negotiate with Salvadorian government to right his wrong. He negotiated deals to hold US prisoners so that must give the US some sort of jurisdiction within that prison. Even if it doesn’t I revert back to DT messed this up and should do everything he can to fix it/make it right. Has he even apologized to the family yet? Offered some sort of compensation? Protection? Assurance?

I wouldn’t want an empty apology from DT, would you? We know he’s an abject liar. Reparations will have to be paid but, he’s still gone. Would we have returned Brittney Griner if Putin claimed there was a clerical error? No, of course not. Trump has zero negotiating leverage here.

Teach_4_change's avatar

Did we strike any kind of deal with Russia to house our prisoners? We have with El Salvador. I think that’s the difference here. We are working with El Salvador on these migrants so why can’t DT continue a discussion with him?

Expand full comment
Allie's avatar

You’re missing the point - it’s a sick and sad point, but, reality - we returned a Salvadoran national to his country. We have zero rights to this particular prisoner. He was in the US for his safety, but not granted any legal status here except asylum. We can’t demand him even be extradited because he didn’t commit a crime here to adjudicate. Legally, we don’t have any claim to him. We handed him back to his country to be tortured. The U.S. is knowingly violating Article 3 & Article 5 of the Convention against Torture. Repercussions from the global community for these offenses are the best recourse at this point.

Teach_4_change's avatar

I’m not missing your point, got it.
