Well since the information about who might have been on that flight came out yesterday/today- the DOJ is playing games w the court. I suspect it’s a measure twice cut once scenario. I am not a strategist but for sure they want to make sure they have good facts - otherwise they lose credibility.

If you know that your adversary is planning to attack, you don’t wait until he attacks to decide your plan of action. That’s just plain stupid. Don’t disagree with you - judges are not prone to knee jerk reactions. They deal a the cases and facts as they come- not a preemptive strike. Congress needed the preemptive strike . To not be overturned on appeal for being over zealous or over reach they have to play the game. It would be like predetermining guilt before giving anyone a fair trial . There is a presumption of innocence and the idea of fairness to the accused . Each case has to stand on its merits. It sucks but it is how our justice system works
