Six Days Away From A TikTok Ban
No matter what happens to TikTok, I'll be providing you with news updates here.
Happy Monday! We are officially six days away from a possible TikTok ban that could see an end to the app as we know it in the United States. Many of you on here have joined me from TikTok, and I want you to know that no matter what happens in the United States Supreme Court, I will be here providing you with timely news updates every single day. With that, I wanted to talk through the future of TikTok, and, from a legal perspective, what you should expect.
There are several possible outcomes that we could have this week.
First, the United States Supreme Court could issue a decision on the merits of the TikTok ban case. That would mean the Court either upholds the ban or strikes it down. If the Court upholds the ban, TikTok’s hail mary would be to hope for a 90-day extension from President Biden, a sale of its U.S. systems, or to appeal to incoming President Donald Trump to avoid enforcement of the ban. If none of those work, then on the 19th, the app will be banned and the serves may shutter. And, it would not just impact TikTok, it would impact CapCut and Lemon8, both apps owned by ByteDance.
Second, the Court could punt on the issue. During oral argument, you may have heard the terms “Administrative Stay” and “Temporary Injunction” floated around. If the Court grants either, it will essentially punt the issue into the Trump Administration. An administrative stay would mean that the Court merely wants more time to decide this critical issue. A temporary injunction, however, would likely mean that the Court believes TikTok is “likely” to succeed on the merits of the issue. Both would kick the can down the road for several months. This is TikTok’s best bet.
Third, the Court could do nothing and just let the ban take effect on January 19th. There is no requirement for the Court to issue a ruling before Sunday. This is the least likely outcome given the urgency of the oral arguments. But, there is a very very small possibility that this happens.
There are many lingering questions that we do not yet have answers to over what actually happens on the 19th, whether Donald Trump has the power to sign an extension on January 20th, and whether President Biden will sign an extension before he leaves office. Thanks to the Biden Administration, the Taiwan Semiconductor Manufacturing Co. has begun producing advanced chips in Arizona. This is the first time in history the United States is manufacturing edge four-nanometer chips on American soil.
California fires are becoming increasingly contained.
Governor Gavin Newsom has issued an executive order that will make it easier for California homeowners to rebuild homes destroyed due to the wildfires. The order will suspend permitting and review requirements under the California Environmental Quality Act and California Coastal Act.
The entire California Republican Congressional delegation, absent one member, fled to Mar a Lago while LA County burns.
MAGA begins turning on JD Vance after he says that only non-violent rioters on January 6, 2021 will be pardoned and that "obviously" violent rioters should not be pardoned.
