BREAKING: A Third Indictment of Donald Trump is Likely Coming Soon
Donald Trump has announced that he received a target letter from the Special Counsel this morning
This morning, Donald Trump announced that he received a target letter from Special Counsel Jack Smith in the investigation into the January 6th insurrection. This announcement was made on Truth Social and can be seen here:
According to Trump’s Truth Social post, he has four days to report to the grand jury investigation the events of January 6, 2021.
What is a target?
In federal criminal investigations, there are three types of labels prosecutors apply to individuals: (1) witnesses; (2) subjects; and (3) targets. A witness is merely an individual with information about the investigation. A subject of an investigation is an individual whose conduct falls within the scope of a grand jury’s investigation.
The government typically considers this individual’s behavior to be suspicious, and is investigating whether the individual actually engaged in criminal activity. Finally, a target is an individual who the government believes there is sufficient evidence that the person committed a crime. A person is usually named a target only when prosecutors are ready to bring criminal charges.
What is this investigation?
The Special Counsel is currently investigating whether Donald Trump and his associates engaged in illegal behavior during or prior to the January 6th insurrection. A grand jury has been empaneled for several months with several top witnesses, including Hope Hicks and Jared Kushner, having testified in recent weeks. Possible charges stem from obstruction of an official proceeding (the counting of the electoral votes) all the way to seditious conspiracy and incitement of an insurrection. Whether Trump is charged and with what remains an open question.
What does this mean for Trump?
When an individual receives a target letter, that individual is often allowed to appear in front of the grand jury to present exculpatory evidence of his or her innocence. Here, Trump notes that he was asked to appear in front of the grand jury within four days of receiving the letter. That will almost certainly not happen. Now that Trump is a target of this federal investigation, his attorneys will take an even larger adversarial role against the Special Counsel to preserve Trump’s 5th Amendment rights. It is highly likely that we will see a third indictment of Trump within the next month as the grand jury wraps up its investigation.
